GENERAL TERMS AND CONDITIONS OF SALE

  • TERMINOLOGY
  • Heidicow hereby refers, by its trade name, to an online store (e-commerce) specialized in the sale of Swiss souvenir items, as well as all services related to this activity.

    The Heidicow.ch website is created and managed by Swisscap Business (Sàrl), a company governed by Swiss law registered in the Commercial Register of the Canton of Vaud: IDE CHE-162.871.085

    Before making your first purchase, you are invited to read carefully the general terms and conditions of sale indicated below. By placing an order, you express your agreement with and your understanding of the said terms.

    Throughout these general terms and conditions, the words “Customer”, “you”, “your” and “yours” refer to any natural or legal person using this Site. The words “we” and “Site” refer to Heidicow .

  • Art. 1 – CATALOG OF ITEMS
  • Heidicow, via its website, presents and sells a selection of Swiss souvenir items. Heidicow is committed to sending you your orders in a safe and fast way.

  • Art. 2 – REGISTRATION
  • 2.1 When accessing this Site, the Customer chooses to place his/her order either in registered Customer mode, following his/her connection (opening) to his/her account at Heidicow, or simply in guest mode.

    2.2 The Customer is responsible for the accuracy of the data he/she provides when registering and ordering on the Site. Therefore, the Customer must inform Heidicow of any changes in the data recorded, where appropriate.

    2.3 The Customer must communicate an active e-mail address to which all messages concerning his/her order will be sent. Any correspondence sent to the Customer by e-mail will be considered as received by the latter on the date and at the actual time of receipt.

  • Art. 3 – ORDERS
  • 3.1 The Heidicow Website enables the Customer to make his/her choice and confirm his/her purchase by using the order form intended for this purpose. Instructions to carry out this process are available on the Site.

    3.2 The photos and illustrations on the Site are not contractual. The original colors could be impacted by slight light shades. 3.3 Your order must be superior to 20 Swiss francs, to be dealt with.

  • Art. 4 – SALE PRICE
  • 4.1 The sale price of items is the one shown on the site when you make your order. Delivery fees are extra and will be indicated once you make your order and at the moment of invoicing.

    4.2 In case of price error on the site, Heidicow reserves the right to cancel the order in question and to refund the Customer in full on the basis of the price paid.

    4.3 All our prices are tax-inclusive, in Swiss franc (CHF) and do not include shipping costs.

    4.4 For all orders sent abroad, the invoiced price will not include taxes. The customs services, or any other authorized operator, will invoice the various taxes applicable in the country where the Customer resides.

    4.5 Swiss taxes do not apply to orders sent abroad. The invoiced price will not include taxes.

    4.6 All foreign taxes, including VAT, formalities and customs duties, as well as shipping costs shall exclusively be borne by the Customer.

    4.7 The prices of our items on the Site are subject to change at any time.

  • Art. 5 – DELIVERY FEES
  • Delivery fees will be indicated when entering your order. The cost varies according to the destination, the weight, the nature of the item and the shipping method chosen.

    5.2 All packages are delivered with a receipt mentioning the items purchased and their total value (information required by the customs authorities)

    5.3 It is the Customer’s responsibility to check with the customs authorities of his/her country on the formalities for importing the items ordered. If a specific document is to be made to facilitate this operation, the Customer must inform Heidicow well before the order is shipped. Otherwise, Heidicow declines any responsibility in case of refusal of the customs authorities to accept the items sent for lack of required documents.

    5.4 It is also the responsibility of the Customer to ensure that the items ordered are legal and comply with the legislation of his/her country. Heidicow, declines any responsibility in case of refusal of delivery because of this point. Therefore, the costs resulting from such a situation will be paid by the Customer.

  • Art. 6 – DELIVERY TIME
  • 6.1 All our shipments are made via Swiss Post

    PostPac Priority: a delivery within 24 hours in Switzerland.

    PostPac Economy: a delivery within 48 hours in Switzerland.

    6.2 For foreign countries, all shipments will be made by priority Post. Delivery times will vary depending on the destination.

    6.3 Heidicow reserves the right to use any other means of delivery in order to respect the delivery time and the cost set forth.

    6.4 Heidcow is committed to send you your orders as soon as possible but cannot be considered at fault in case of delay.

    6.5 Items available when you make your order are sent within 24 hours upon receipt of your payment. Items not available in stock will be shipped upon delivery by our suppliers. Heidicow is committed to reducing waiting time to the absolute minimum.

  • Art. 7 – METHODS OF PAYMENT
  • Heidicow puts at your disposal 3 means of payment:

       – Secure payment with Stripe by credit card: VI / MC / AE

       – Payment by bank transfer

       – Orange payment slip valid only for residents in Switzerland.

    7.1 Secure payment by credit card with Stripe

       VISA – MasterCard ¬- American Express (CHF, EUR & USD)

       Stripe provides a 100% secure payment system by credit card (Visa, Mastercard, AmericanExpress). Bank data is instantly encrypted thanks to the PostFinance 3D protocol. We have no way to access this data.

    7.2 Payment by bank transfer

       The total amount of the order must be transferred in advance to our account. The order will be delivered to the Customer upon registration of his/her payment. The speed of payment will determine the delivery time.

       Important: Please put the order number as the reason for the payment.

    7.3 Payment by orange remittance slip (ISR)

       This payment method is reserved only for Customers who reside in Switzerland.

       All orders not paid within 21 days will be automatically canceled.

  • Art. 8 – NON AVAILABILITY OF ITEMS
  • Satisfying the wishes of our Customers is our major objective. Nevertheless, Heidicow declines any responsibility for a temporary or definitive unavailability of one or more items offered for sale. Heidicow also reserves the right to refuse certain orders.

  • Art. 9 – WITHDRAWAL AND RETURN
  • According to the current legislation on mail-order sale and internet sales, the Customer may return any item within 7 days of receipt. Nevertheless, the following conditions are mandatory to accept such a return:

    9.1 The received item must never be used or degraded and must be returned in its original packaging.

    9.2 A refund for the returned order will be made. However, the shipping costs and those related to the collection will be borne by the Customer (4% of the total amount of the invoice).

    If any of the above conditions are not met, no refund can be claimed.

  • Art. 10 – DEFECTIVE ITEMS
  • 10.1 Heidicow systematically checks all items before shipping. However, when receiving the order, the Customer must immediately check the items delivered.

    Where appropriate, before signing the delivery order of the carrier, the Customer must ensure that the delivery matches his/her order. In case of obvious defects, the Customer (or any other person receiving the goods for him/her) must mention it on the delivery note, in the form of a handwritten with his/her signature. Without this document, no claim or return will be possible.

    10.2 For defects that are not apparent at the time of delivery against signature, or in the absence of such a delivery method, the Customer must inform the Customer Service within 3 business days from the moment the defect has been found, otherwise the defect will be considered as accepted.

    10.3 To indicate a possible defect, the Customer must send an e-mail to Heidicow indicating his/her order number, his/her contact information and a description of the defect found. In the event of non-resolution by means of an e-mail exchange, the Customer is invited to return the defective item to Heidicow respecting the following points:

       – The defective item must be returned in its original packaging to Heidicow address together with a copy of the e-mail exchange for a prompt processing.

       – In addition to its original packaging, the returned item must be equipped with all its accessories. Otherwise, no return or exchange would be possible.

    10.4 After verification, and if the item is found to be defective, Heidicow will cover the cost of reshipping the replacement item. However, if we are in the presence of a compliant item, an invoice for the shipping cost of the new delivery will be sent separately. The replacement item will be delivered to you upon receipt of your payment.

    10.5 In case of an order consisting of several items, the defective nature of an item, its replacement or the impossibility of shipping it does not invalidate the whole order. Heidicow manages each product separately.

  • Art. 11 – GUARANTEE
  • The items sold on the Site are guaranteed by their suppliers. Heidicow offers no guarantee whatsoever. Article 199 co (fraudulent concealment of a defect) is reserved.

  • Art. 12 – LOSS OR THEFT OF A PACKAGE
  • In case of loss or theft of your package, you are insured in accordance with the general terms and conditions of the carrier.

  • Art. 13 – CASES OF FORCE MAJEURE
  • Heidicow declines any responsibility in case of force majeure, examples: strikes, natural disasters, geopolitical crises, fires … etc. (non-exhaustive list).

  • Art. 14 – DATA PROTECTION AND CONFIDENTIALITY
  • We are committed to act and comply with the legal provisions on data protection. Your personal data is dealt with confidentially and will not be exploited or transferred to another company.

  • Art. 15 – DATA PROCESSING AND FREEDOM
  • A guaranteed access is given to the Customer to modify or delete the information that concerns him/her. The Customer can contact Heidicow at any time to make the desired changes. Only information collected in the form of cookies relating to the items ordered will be kept for internal business analysis purposes.

  • Art. 16 – RESPONSIBILITY AND ADMISSIBLE USE POLICY
  • 16.1 The Customer is required to keep his/her identification data secret and is liable for any damage resulting from the breach of this obligation. If the Customer knows or suspects that a third party has access to his/her user account, he must notify Heidicow immediately.

    16.2 In case of misuse of this Site, Heidicow reserves the right to disable the account of one or more Customers.

    16.3 Heidicow reserves the right to modify the General Terms and Conditions of Sale at any time.

  • Art. 17 – JURISDICTION
  • The conditions of use are subject to Swiss law, excluding the rules of private international law. The place of exclusive jurisdiction for all disputes will be CH 1196 – Gland.

    The conditions of use are written in French, English and German. In case of discrepancies, the French version will prevail.

    These general terms and conditions are applicable as of 01 January 2019.
